Ewing McNutt owned the following property, which was sold during probate:
the East half of the South Easst quarter of section 27 in Township 18
north of Range 9 West situate in the county of Fountain Indiana; this
land was sold to John Laverty by order of the court during probate.

Oliver McNutt in the Admin. Of the Estate of Ewing McNutt Dec. [note:
"Dec" means Decedent or Deceased]
And now on this day comes the said admin. And it appearing to the
satisfaction of this court that the papers in this case together with the
record of the letters of administration to him granted have been consumed
by fire in the burning of the Clerks Office of this County. It is
therefore ordered that this case be in all things reinstated, whereupon
the said Adm. Produced the original letters of Administration to him
granted which were ordered to be recorded as of a former date towit the
second day of March 1829. and which said letters with the official
endorsement thereon read in the words and figures following to wit :State
of Indiana Parke County, James Nesmith and James Strange associate
Judges of the circuit Court in and for said county to Oliver McNutt of
the County aforesaid Greeting whereas Ewing McNutt late of said County
deceased died intestate as is said. We do therefore give and grant unto
the said Oliver McNutt full power and authority to administer all and
singular the goods chattels and credits. Of the said Deceased and to
demand, collect and levy and in legal manner require and receive all and
all manner of debt and debts due and owing to the said deceased and well
and faithfully to dispose of the same and out of the goods chattels and
credits of the said deceased which have may or shall come to your
knowledge hands or possession well and truly to pay the debts due by the
said Deceased so far forth as the time will extend or the law will charge
you according to the true value of the sum thereof you having first taken
your oath well and truly to administer the same and to make or cause to
be made a true and perfect inventory of all and singular the goods
chattels and credits of the said deceased together with a list of debts
separate and disperate which have may or shall come to your hands
knowledge or possession appraised in dollars as also to render a true and
just account of and upon your administration therein and to exhibit both
unto the said judges in session touching which inventory you are
presently assigned to perform or at farthest within twelve months and an
account within twelve months from the date of these presents and lastly
we do hereby constitute and appoint you the said Oliver McNutt
administrator of all and sigular the goods and chattels and credits of
the said deceased. Witness Wallice Rea clerk of our said Court at
Rockville the 2nd day of March eighteen hundred and thirty two. For

State of Indiana Parke County SP Be it remembered that on this day to
wit, the second day of March A.D. 1829 . Before me Wallice Rea Clerk of
the Circuit Court in and for the County aforesaid personally came Oliver
McNutt administrator of all and singular the goods and chattels and
credits of Ewing McNutt late of said County deceased and made oath on the
Holy Evangelly Almighty jGod that he did not know and that he had not
hard any will having been made by the said deceased and that he would
well and truly administer all and singular the goods chattels and credits
of the said deceased according to the terms of the letter of
administration to him granted and according to law, and that he would
under a Just and true account of and upon his administration therein when
thereto he should be lawfully called. In Testimony whereof I have
hereunto set my hand and seal the day and year above written For Wallice

real estate, The Heirs at Law of said Decd.
And Now at this time comes the said Admin. And on the suggestion that the
personal property of said deceased is insufficient to discharge the Debts
due by the said Decedent, It is therefore ordered by the Court that
publication of the pendency?? Of this application be made in the Wabash
Herald a public Newspaper printed and published at Rockville in the
county of Parke four Weeks successively previous to the next Term of this
court Notifying in the nonresident heirs at law of said estate towit,
James McNutt, Joseph McNutt, Michael Blair and Jane his wife formerly
Jane McNutt, to be and appear here on the first day of the said next of
the court to show cause if any they can why the real estate of the said
decedent may not be sold and made assets in the hands of said
Administrator for the payment of said debts and that a summons do issue
against the resident heirs of said deceased towit John McNutt, Samuel
McNutt, John M.Lavirty and Nancy his wife formerly Nancy McNutt, to be
and appear here at the same time for the same purposes as aforesaid and
this cause is continued.

p.24& 2: Oliver McNutt Admin. Of estate of Ewing McNutt decd. Vs. The
heirs at law of said deceased. Application to sell real estate.
And now at this time comes the said Admin. And this appearing to the
satisfaction of the court that publication of this application had been
made agreeably to the order made at the last term of this court and the
summons issued. In this cause against the resident heirs at law of said
deceased living returned served and the said heirs being three times
solemnly called John McNutt and Samuel McNutt comes here in open court
and say they have now can show no cause why the real estate of the said
deceased shall not be sold by the said administrator accrding to his
prayer and the other heirs having failed to appear it is ordered adjudged
and decreed by the court now here that the administrator proceed to sell
the real estate of the said deceased twit the East half of the South
Easst quarter of section 27 in Township 18 north of Range 9 West situate
in the county of Fountain Indiana on the premises on the fourteenth day
of September next on a credit of six months for one half of the purchased
money and the residue in hand and it is further ordered by the court that
the said administrator give notice of the time and peace of the said sale
by four successive publications thereof in the Wabash Herald and this is
continued.

hand , ½ of the remainder in six months and the remainder in 12 months by
the purchaser thereof giving bond and approved secutity and it is further
ordered by the court that previous to offering the said land for sale the
said admin. Give notice of the time and place of such sale by printing up
written advertisements in those of the most public places in the vicinity
of said land and also by advertising the same for three weeks
successively in the Wabash Herald a weekly newpaper printed and published
at Rockville Parke County, Ind. and that he report his preceedings in the
premises to the next term of this court. Ordered that court adjoiur
until court in course. Signed Febry. 14, 1834ale to be Sept. 13, next
(1834) publication to be in Western Constellation a weekly newspaper
